Fifth level fighter? Should be grind the orcs just by outlasting them on hit points. Maybe take a shot at declaring his free hand as an off-hand attack the first round to see if he can still hit the orcs w/penalty. If he can, then it's an easy one-round KO on both, combinaing minimum damange from the short sword with the non-lethal damage from the punch. Assuming this is 3.5 we're talking about, then orcs only have one hit die, approximate 4 hit points each, and are CR 1/4.
